GENERAL TERMS AND CONDITIONS

We operate based on the General German Forwarder Conditions (ADSp), in each case the latest version. These limit in clause 23 of the ADSp the legal liability for goods damage according to § 431 HGB for damages in forwarding custody to 5 euros per kg, for multimodal transports including a sea transport to 2 SDR (Special Drawing Rights) per kg, and furthermore per case of damage or event to 1 million or 2 million euros, or 2 SDR per kg, whichever amount is higher.

Additionally, it is agreed that

(1) Clause 27 of the ADSp neither extends the liability of the forwarder nor the attribution of fault of employees or other third parties in deviation from legal provisions such as § 507 HGB, Article 25 of the Montreal Convention, Article 36 of the CIM (Convention concerning International Carriage by Rail), Articles 20, 21 of the CMNI (Convention on the Contract for the International Carriage of Goods by Inland Waterways) to the benefit of the client,

(2) the forwarder, acting as a carrier, is involved in the cases specified in § 512 paragraph 2 No. 1 HGB, in cases of nautical fault or fire on board, is liable only for his own fault, and

(3) the forwarder, as a carrier in the sense of the CMNI, under the conditions specified in Article 25 paragraph 2 CMNI, is not liable for nautical fault, fire on board, or defects of the ship.
